Preliminary Approval Granted in Aspirus Patient Data Privacy Class Action

Overview

Judge Jacobson granted preliminary approval of a class action settlement in Mrozinski v. Aspirus, Inc., No. 2023CV000170,  appointing Almeida Law Group’s Managing Partner, David S. Almeida, as Settlement Class Counsel in litigation concerning the alleged unauthorized disclosure of patient data to third parties. 

We are very pleased to announce that the Honorable LaMont K. Jacobson of the Circuit Court for Marathon County, Wisconsin has granted preliminary approval of a class action settlement in Mrozinski v. Aspirus, Inc., Case No. 2023CV000170, a case involving allegations that Aspirus disclosed patients’ personally identifiable and protected health information to third parties, including Meta, through its website. 

Managing Partner David S. Almeida was appointed as Settlement Class Counsel. He joins a leadership team that includes Gary M. Klinger of Milberg Coleman Bryson Phillips Grossman PLLC, Raina Borrelli of Strauss Borrelli PLLC and Foster C. Johnson of Ahmad, Zavitsanos & Mensing PLLC. Together, they will oversee all aspects of the litigation including notice, claims administration, final approval proceedings and any appeals. 

The Court found the proposed settlement to be fair, reasonable and adequate and approved the notice program to inform class members of their rights. A final approval hearing will be scheduled no earlier than 120 days from the date of preliminary approval.
