Final Approval Granted in San Diego Fertility Center Patient Privacy Class Action

Overview

The Superior Court of California has granted final approval of a class action settlement involving nearly 60,000 patients whose sensitive data was allegedly exposed through tracking technologies used by San Diego Fertility Center and Ivy Fertility Services. 

We are pleased to announce that the Honorable Marcella O. McLaughlin of the Superior Court of California for the County of San Diego has granted final approval of the class action settlement in Jane Doe v. San Diego Fertility Center Medical Group, Inc., Case No. 37-2024-00006118-CU-BC-CTL. 

  

The litigation involved allegations that San Diego Fertility Center and Ivy Fertility Services improperly disclosed sensitive patient information through tracking technologies embedded on their websites. The certified class includes nearly 60,000 individuals who accessed Defendants’ websites between January 2020 and April 4, 2025. The Court previously granted preliminary approval and has now found the settlement to be fair, reasonable and adequate under California law.
