On January 12, 2026, in Gorder v. FCDG Management, LLC d/b/a First Choice Dental, Case No. 2024CV002164, Judge Benjamin Jones of the Circuit Court for Dane County, Wisconsin granted final approval of a class action settlement resolving claims arising from a data incident discovered in October 2023 that implicated patient private information.
The Court found that the Settlement satisfied all requirements for class action treatment under Wis. Stat. § 803.08 and approved the Settlement as fair, reasonable and adequate. The Court also overruled two objections, noted that no class members opted out and dismissed the action with prejudice.
In granting final approval, the Court reaffirmed the appointment of David S. Almeida of Almeida Law Group LLC and Raina C. Borrelli of Strauss Borrelli PLLC as Settlement Class Counsel. The Court further approved an award of attorneys’ fees and costs to Settlement Class Counsel as well as service awards to the Class Representatives.
