by: Almeida Law Group

Attorneys at Almeida Law Group are investigating whether a class action lawsuit can be filed on behalf of individuals affected by a possible Bayview Real Estate WARNING data breach. According to dark web monitoring sources, a hacker group calling itself ShadowByt3$ claimed responsibility for a cyberattack on Bayview Real Estate WARNING in a post first observed in August 2026, alleging it had gained access to internal company systems. As of this writing, Bayview Real Estate WARNING has not issued a public confirmation of the incident, and the exact scope of any exposed data remains unknown. If you believe you were affected, contact Almeida Law Group.

About Bayview Real Estate WARNING

The true identity of the targeted organization is unclear. The extortion message published by ShadowByt3$ references email addresses at bayview.com, which belongs to Bayview Asset Management LLC, an investment management firm founded in 1993 and headquartered in Coral Gables, Florida, that specializes in mortgage and consumer credit with approximately $45.5 billion in assets under management as of June 2026. The same message also references the domain pm.livable.com, which belongs to Livable, a proptech company that provides multifamily utility billing and cost recovery software for property managers. The Ransomware.live listing categorizes the victim as “Retail & E-Commerce,” a classification that does not match either organization. The word “WARNING” in the listed victim name appears to be part of the threat actor’s formatting rather than an actual organization name. It is not possible to determine from available sources whether the intended target is Bayview Asset Management, Livable, a property managed through Livable’s platform, or some other entity entirely.

What Happened?

This incident is based solely on an attacker-side dark web claim in a ransomware leak-site allegation reported by Ransomware.live and documented by the third-party threat-tracking blog hendryadrian.com. ShadowByt3$ claims to have stolen 216.6 MB of data and listed several email addresses at bayview.com and livable.com as alleged proof. The group set a deadline of August 29th, 2026, for the targeted organization to respond, threatening to publish the data if no contact was made. No independent corroborating source has confirmed that an actual intrusion occurred, and no specific data types have been identified or confirmed by any victim organization or regulator.

ShadowByt3$ is widely regarded in the threat intelligence community as a low-credibility actor. According to SOCRadar, the group emerged in October 2025 and uses a double extortion model. Barricade Cyber Solutions describes the group as demonstrating “consistently amateur tradecraft,” noting that its Bitcoin wallet shows no significant ransom payments, its Windows ransomware payload was broken for weeks, and it leaked its own source code. CyPro characterizes ShadowByt3$ as “a relatively low-credibility threat actor known for making unverified or even fabricated claims.” The group has previously made unconfirmed claims against Nintendo, the University of Georgia, and Nottingham Trent University, among others; Nintendo specifically stated that no personal consumer data had been compromised. No litigation connected to this August 2026 claim has been identified.

Separately, Bayview Asset Management has a significant prior breach history that is unrelated to this claim. In October 2021, a Bayview employee unknowingly downloaded malicious software, leading to a confirmed breach affecting approximately 5.8 million customers across Bayview and its subsidiaries. In January 2025, Bayview settled with 53 state financial regulators for $20 million over deficient cybersecurity practices. A related $26 million class action settlement — In re Lakeview Loan Servicing Data Breach Litigation, Case No. 1:22-cv-20955-GAYLES — received final approval from U.S. District Judge Darrin P. Gayles in July 2026. That matter is fully separate from the current unverified ShadowByt3$ allegation.

Because the victim’s identity has not been confirmed and no specific data types have been disclosed, it is not yet possible to say with certainty who may be at risk. If you have received communications from Bayview Asset Management, Livable, or any associated property management service and are concerned your information may have been exposed, you should consider placing a fraud alert or credit freeze with the three major credit bureaus and monitoring your financial accounts closely for suspicious activity.
